What is Copyright?

Copyright is a statutory right granted to the creator of an original work, conferring exclusive legal rights over its use, reproduction, distribution, and adaptation.

It protects intellectual property such as:

Importance of Copyright Registration

Copyright in India is governed by the Copyright Act, 1957.

Protection arises automatically once a work is created and expressed in a tangible form. The validity of copyright subsists for the lifetime of the author plus 60 years thereafter.

While copyright exists from the moment of creation, registration offers significant legal and commercial advantages:

  • Legal Proof of Ownership - Serves as prima facie evidence in court.
  • Protection Against Infringement - Enables legal remedies against unauthorized use.
  • Monetisation Opportunities - Rights can be licensed, assigned, or sold.
  • Public Record - Establishes authenticity and ownership in official records.

Works Eligible for Copyright Registration in India

The Act recognizes the following categories:

  • Literary Works - Books, articles, manuscripts, software, databases, compilations, translations, etc.
  • Dramatic Works - Plays, scripts, screenplays, theatrical content
  • Musical Works - Original musical compositions (melody/arrangement), excluding sound recordings.
  • Artistic Works - Paintings, drawings, photographs, sculptures, maps, architectural works, etc.
  • Cinematograph Films - Movies, web series, documentaries, advertisements, animations.
  • Sound Recordings - Songs, audiobooks, podcasts, speeches, audio content.

Copyright Registration Process in India

Only original works expressed in tangible form qualify for protection.

The process is governed by the Copyright Act, 1957 and Copyright Rules, 2013.

Step 1 - Filing of Application (Form XIV)

Provide:

  • Title & nature of work
  • Language
  • Applicant details
  • Publication status

Upload:

  • Signature copy
  • Copies of the work
  • Source code (for software)
  • NOCs (if applicable)

Statements of Particulars & Further Particulars must also be filed.

Step 2 - Payment of Fees

Fees are paid online. Upon payment, a Diary Number is generated for tracking.

Step 3 - Objection Waiting Period: A mandatory 30-day period is provided for third-party objections.

Step 4 - Scrutiny by Registrar

  • If no objections → Application examined.
  • If objections → Notice issued to parties.

Step 7 - Hearing (If required): Registrar hears both parties and decides the matter.

Step 8 - Issuance of Certificate: Upon approval, the Copyright Registration Certificate is issued, serving as legal proof of ownership.
